  • Patent-Related Information: To perform a validity analysis, you only need to provide us with the patent number.  To perform a patent strength analysis, you will be required to provide us with a copy of the pleadings/notice of opposition, prior art and supplementary information cited against the patent that you wish to have evaluated by us.
  • Payment Information: We do not collect payment information.  We will invoice you separately with our banking information after you have received our final work product.


How We Use Your Information

We use the information we collect for the following purposes:

  • To Communicate with You: We use your contact information to provide updates on your analysis and respond to your inquiries.
  • For Legal and Compliance Purposes: We may use your information as necessary to comply with legal obligations, enforce our terms of service, or protect our rights and the rights of others.

Terms and Conditions


These Terms and Conditions ("Terms") govern your use of the website at priorartistry.com and the professional prior art searching services ("Services") we provide. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Services.


1. Services Provided

Prior Artistry provides professional patent validity analysis services to assist clients in evaluating the  validity of an invention. Our services include, but are not limited to, conducting searches of patent and non-patent literature and providing a report of the findings. Our services do not constitute legal advice. The reports and information we provide are for informational purposes only. They are not a substitute for the advice of a qualified patent attorney or legal professional. You are solely responsible for all decisions and actions taken based on our search results.


2. Client Obligations and Confidentiality

a. Information Provided: You agree to provide accurate, complete, and truthful information as necessary for us to perform the Services. You are responsible for ensuring that the information you submit does not infringe upon the rights of any third party.

b. Confidentiality: Prior Artistry agrees to treat all information you provide as confidential. We will not disclose this information to any third party without your express written consent, except as required by law. This obligation of confidentiality does not apply to information that is already publicly known or becomes public through no fault of Prior Artistry.


3. Fees and Payment

a. Service Fees: You agree to pay the fees for the Services as specified on our website or in a separate agreement. All fees are quoted in Euro unless otherwise stated.

b. Payment:  Payment for our Services is due within 30 days of the invoice date. Invoices that are not paid within this period will be subject to a 10% late fee for each calendar month that the payment is overdue. 

c. No Guarantees: You acknowledge that a prior art search is not an exact science, and whilst we are confident in our novel approach and will endeavor to find all relevant prior art, we cannot guarantee that we will find all relevant prior art. Payment for our Services is for the diligent performance of the search and subsequent validity analysis, not for the outcome or for any particular result.


4. Intellectual Property

a. Ownership: All rights in and to the materials you provide to us remain your property.

b. Our Work Product: All intellectual property rights in and to our work product, including our search methodologies, databases, and the formatting of our reports, are and will remain the exclusive property of Prior Artistry.  We will not disclose our search and analysis techniques as we consider them trade secrets that have taken significant time, effort and resources to develop.


5. Limitation of Liability

To the fullest extent permitted by law, Prior Artistry and its employees shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our Services or reliance on our reports. Our total liability to you for any and all claims shall not exceed the amount you paid for the specific Service giving rise to the claim.  Prior Artistry does not use external agents or contractors.


6. Indemnification

You agree to indemnify, defend, and hold harmless Prior Artistry and its employees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any third party's rights.


7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law principles. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Dublin, Ireland.


8. General Provisions

a. Entire Agreement: These Terms constitute the entire agreement between you and Prior Artistry regarding the Services and supersede all prior or contemporaneous agreements, whether written or oral.

b. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

c. Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

Complaints and Dispute Resolution

 

At Prior Artistry, we are committed to providing high-quality services. Of course, we understand that, despite best efforts, things can go wrong.  If you have a complaint about our services, please follow these steps:

  1. Initial Contact: You must first submit your complaint in writing to us at jim@priorartistry.com. Please include a detailed description of the issue, along with any relevant documents or evidence.  
  2. Our Response: We will acknowledge receipt of your complaint within 3 business days and will make every effort to provide a substantive response and resolution within 20 business days. Our primary focus is to resolve all complaints swiftly and amicably.
  3. Mediation: If we are unable to resolve your complaint through our internal process, you agree to engage in mediation before pursuing any other legal action. The mediation will be conducted by a mutually agreed-upon mediator in Dublin, Ireland, and the costs of the mediation will be shared equally between both parties.
  4. Jurisdiction: Any legal action arising from a dispute that cannot be resolved through mediation will be governed by the laws and courts specified in the Governing Law and Jurisdiction clause of the Terms and Conditions.
